Age and Regulated Product Notice: The Service sells heated tobacco consumables, which are regulated, age-restricted products under UAE law. 3. Placing Orders for Goods

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts and that You meet the age requirement described in Section 2.

Your Information

To place an Order, You may be asked to provide information including, without limitation, Your name, email address, phone number, payment details, billing address, and shipping information.

You represent and warrant that:

  1. You have the legal right to use any payment method used in connection with an Order; and
  2. the information You supply to Us is true, correct, and complete.

By submitting this information, You authorize Us to share it with payment processors solely to facilitate completion of Your Order, in accordance with the PDPL and Our Privacy Policy.

Pricing and Taxes

All prices displayed on the Service are quoted in UAE Dirhams (AED) and are inclusive of 5% Value Added Tax (VAT) unless stated otherwise. The total price shown at checkout, including VAT and any delivery charges, will be the final amount charged — there are no hidden fees added after checkout confirmation.

Order Cancellation by the Company

We reserve the right to refuse or cancel Your Order at any time for reasons including, but not limited to:

  • Unavailability of Goods
  • Errors in the description or price of Goods
  • Errors in Your Order
  • Suspected fraud or an unauthorized or illegal transaction
  • Failure to verify the minimum age requirement for regulated tobacco-related products

If We cancel a paid Order, You will receive a full refund using Your original payment method within a reasonable time.

4. Your Right to Cancel and Returns

Any Goods You purchase may only be returned in accordance with these Terms and Our Returns Policy, which forms part of these Terms.

Your right to cancel an Order applies only to Goods returned in the same condition in which You received them, including all original packaging, instructions, and documentation. Goods that are damaged, used, or not in their original condition will not be refunded. Please take reasonable care of Goods while in Your possession.

Where a refund is due, We will reimburse You within 14 days of receiving the returned Goods, using the same payment method You used for the Order, at no extra cost to You.

You do not have the right to cancel an Order for:

  • Goods made to Your specifications or clearly personalized;
  • Goods which, by their nature, deteriorate rapidly or have an expiry date;
  • Goods that are unsealed after delivery and are not suitable for return for health or hygiene reasons — this includes heated tobacco consumables and similar single-use or hygiene-sensitive products once the seal has been broken;
  • Goods that, after delivery, are inseparably mixed with other items;
  • Unsealed digital content, once performance has begun with Your prior express consent.

Defective or Non-Conforming Goods: Nothing in this section limits Your statutory rights under Federal Law No. 15 of 2020 on Consumer Protection and its Executive Regulations. Where Goods are defective, damaged in transit, or do not match their description, You are entitled to repair, replacement, or refund in accordance with UAE consumer protection law, regardless of any packaging condition described above.

5. Availability, Errors, and Inaccuracies

We regularly update Our offering of Goods on the Service. Goods may occasionally be mispriced, described inaccurately, or unavailable, and We may experience delays updating this information.

We do not guarantee the accuracy or completeness of information on the Service, including prices, images, and specifications, and We reserve the right to correct errors or update information at any time. Where a pricing error is identified before an Order is fulfilled, We will contact You to confirm the correct price or offer a full refund.

6. Prices Policy

We reserve the right to revise prices at any time prior to accepting an Order. Once an Order is accepted, the confirmed price will not increase, except where required by a change in government-imposed taxes or duties beyond Our control — in which case You have the right to cancel Your Order and receive a full refund.

7. Payments

10. Termination

We may suspend or terminate Your Account at any time, without prior notice, if You breach these Terms. Upon termination, Your right to use the Service ceases immediately. You may terminate Your Account at any time by discontinuing use of the Service.

11. Limitation of Liability

To the maximum extent permitted under UAE law, the total liability of the Company and its suppliers for any claim arising from these Terms or Your use of the Service is limited to the amount actually paid by You through the Service, or AED 350 if You have not made a purchase.

The Company shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business interruption, arising from or related to the use of or inability to use the Service.

Nothing in this section excludes or limits liability that cannot be excluded or limited under UAE Federal Law No. 15 of 2020 on Consumer Protection or any other mandatory provision of UAE law, including liability for defective or unsafe Goods.

12. “As Is” and “As Available” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, to the maximum extent permitted by UAE law. The Company does not warrant that the Service will be uninterrupted, error-free, or free of harmful components, and does not guarantee that the Service will meet Your specific requirements.

This disclaimer does not affect any statutory warranty You are entitled to under UAE consumer protection legislation, including the minimum warranty period applicable to durable goods.

13. Governing Law and Disputes

These Terms, and Your use of the Service, are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles, and specifically by Federal Law No. 15 of 2020 on Consumer Protection, Federal Decree-Law No. 14 of 2023 on Trading through Modern Technology (E-Commerce Law), and their respective Executive Regulations.

If You have a concern or dispute, please contact Us first using the details in Section 17 so We can attempt to resolve it informally. If the matter remains unresolved, You may escalate Your complaint to the UAE Ministry of Economy or the relevant local Department of Economic Development, or pursue the matter before the competent courts of Dubai, UAE.

14. Severability and Waiver

Severability: If any provision of these Terms is found unenforceable or invalid, that provision will be interpreted to achieve its objectives to the greatest extent possible, and the remaining provisions will remain in full force.

Waiver: Failure to enforce a right or provision under these Terms does not constitute a waiver of that right, nor a waiver of any subsequent breach.

No Harmful Terms: In accordance with the Executive Regulations of the Consumer Protection Law, no provision in these Terms shall be interpreted to unilaterally exempt the Company from its legal obligations to consumers, waive a consumer’s statutory rights, or permit unilateral amendment of the contract to the consumer’s detriment.

15. Language

These Terms are made available in English and Arabic. In the event of any conflict or ambiguity between the two versions, the Arabic version shall prevail, in accordance with UAE law. (Note: if only an English version currently exists, an Arabic translation should be prepared and published alongside it, as UAE law requires contractual and consumer-facing information to be available in Arabic.)

16. Changes to These Terms

We may modify or replace these Terms at any time. For material changes, We will make reasonable efforts to provide at least 30 days’ notice before the new terms take effect.

By continuing to access or use the Service after revised Terms take effect, You agree to be bound by them. If You do not agree, please stop using the Service.
